ResurgoTerms of Service
These Terms of Service ("Terms") govern your use of the Resurgo mobile application and related services (the "Service"), operated by Ascend Life Coach LLC (d/b/a Resurgo) ("Resurgo," "we," "us," or "our"). By using Resurgo, you agree to these Terms. If you don't agree, please don't use the Service.
Important — Resurgo is not professional advice. Resurgo provides AI-generated coaching, plans, and content for general informational and motivational purposes only. It is not medical, mental-health, nutritional, financial, legal, or other professional advice, and it is not a substitute for a qualified professional. Always consult an appropriate professional before making decisions about your health, finances, or wellbeing — and seek medical care before starting any new exercise or nutrition program. You use Resurgo's guidance at your own risk and are solely responsible for your choices and actions.
Eligibility
You must be at least 18 years old to use Resurgo. By using the Service, you confirm that you are.
Your account
You're responsible for keeping your account secure and for activity under it. Provide accurate information and keep it up to date.
License
We grant you a personal, limited, non-exclusive, non-transferable license to use Resurgo for your own personal, non-commercial use, subject to these Terms.
Subscriptions, billing & purchases
- Resurgo offers paid subscription tiers and optional one-time "Boost" purchases. Current pricing is shown in the app.
- Subscriptions are auto-renewing. Payment is charged to your Apple App Store account at confirmation and renews each period unless you cancel at least 24 hours before the period ends.
- You manage and cancel subscriptions in your Apple App Store account settings — not within the app.
- "Boost" purchases are one-time, consumable add-ons applied to your account.
- Except where required by law or by Apple's policies, purchases are non-refundable. Refund requests for App Store purchases are handled by Apple.
- We may change prices or features; we'll give notice of material changes as required.
Acceptable use
You agree not to misuse the Service, including: breaking the law, infringing others' rights, attempting to access the Service in unauthorized ways, reverse-engineering or disrupting it, or using it to harm yourself or others.
Your content
You own the content you create in Resurgo. You grant us a limited license to store and process it solely to operate and improve the Service for you, as described in our Privacy Policy.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for your circumstances.
Limitation of liability
To the fullest extent permitted by law, Resurgo and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service or your reliance on any content. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.
Termination
You may stop using Resurgo and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users.
Apple App Store
If you download Resurgo from the Apple App Store, you acknowledge:
- These Terms are between you and Ascend Life Coach LLC only, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability, legal, regulatory, or intellectual-property claims.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Governing law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. Disputes will be resolved in the courts located in Indiana.
Changes to these Terms
We may update these Terms from time to time. We'll update the date above and, for material changes, notify you in the app or by email. Continued use means you accept the updated Terms.
